A notice of opposition must be filed within three months after the registration of a German mark. In the case of a Europem trademark, the opposition must be filed within three months after publication of the European trademark application.

An opposition can be based on an earlier filed or registered national trademark, a European trademark or an IR trademark. Moreover, the trademark opposition may also be based on an earlier business name or a company name or on an earlier used internet domain.
